Motorcycle Accident Lawyer Queens New YorkThe rules governing motorcycles are vastly different for motorcycles than for car accidents in New York State. Specifically, a motorcycle is not a “motor vehicle” within the meaning of the insurance No-Fault law. Therefore, a motorcyclist is not a “covered person” under the New York State No-Fault Regulation, and is therefore, not entitled to medical benefits and lost wages provided by a No-Fault insurance carrier.

Given this exemption, motorcyclists who have been involved in a motorcycle accident and have been suffering from a serious injuries must use their private health insurance for medical treatment.  Our Queens Motorcycle Accident Attorneys understand the hardships that motorcycle accidents cause to injured victims and their families and strive to obtain maximum compensation, including all expenses incurred by the injured victim, including, lost wages, medical treatment and for their bodily injuries.

Notably, since Motorcyclists do not qualify under the New York State No-Fault law, injured motorcyclists do not have to satisfy the No-Fault “serious injury” threshold law. Therefore, an injured motorcyclist is entitled to compensation from the at-fault party even for minor injuries.
