I was injured at work. What Workers' Compensation benefits am I entited to?

Once your workers’ compensation claim has been accepted by the insurance company, you are entitled to reasonable and necessary treatment to cure or relieve you of the effect of your work injury. If you are missing time from all type of work as a result of your work injury, our attorneys will fight for your lost wages and recover a potential settlement if a permanent restriction is found by a medical physician towards the end of your injury claim.

No upfront legal fees or medical expenses. Our firm works based off of our contingency fee basis which means that our firm only gets paid if we recover money for you. Medical bills are covered under the workers’ compensation insurance company, assuming they accept the claim.

 

Injured workers’ losing time from work will receive workers’ compensation checks every two weeks on a day in which the insurance company selects. For your convenience, you can opt for direct deposits.

 

It is illegal for an employer to terminate an employee for reporting a workers’ compensation claim. If your employer terminates, discriminates, or demotes you after a work injury after your report of injury, you are entitled to a 50% increase in your benefits.

 

In New York State, Workers’ Compensation is a no-fault system. In other words, you are entitled to benefits even if the injury was your fault.
