What is Workers' Compensation and what am I entitled to?
Experiencing a workplace injury can be overwhelming—especially when it impacts your health, income, and well-being. Workers’ Compensation is a no-fault insurance system designed to protect employees who are injured or made ill on the job. This coverage provides critical support, including medical expenses and lost wages, without requiring you to prove employer fault. However, while the law is designed to benefit workers, the process can be challenging without experienced legal guidance.

Initiating Your Workers' Compensation Case
Following a workplace accident, certain steps can significantly improve your chances of a successful claim:
- Report the Injury Right Away: New York law requires that workplace injuries be reported within 30 days. Inform your supervisor in writing and keep a copy for your records.
- Seek Qualified Medical Attention: It’s vital to see a doctor approved by the New York Workers’ Compensation Board, and to inform them that your injury is work-related. Your initial medical report should have all sites of injuries properly diagnosed by your physician with a temporary degree of disability percentage (TTD). If you are losing time from work as a result of the injury, the workers’ compensation insurance carrier will cover up to 66% (2/3) of your salary assuming that your claim has been accepted by the insurance company and your doctor indicates that you are 100% temporarily totally disabled.
- File Your Claim: Submitting Form C-3 to the New York Workers’ Compensation Board within two years of the accident is critical to securing your benefits. Our office ensures that the C-3 form is accurately filled out as this document is vital for your claim.
- Avoid Common Pitfalls: Small mistakes in documentation or deadlines can jeopardize your claim. Beck Law P.C. is here to help you avoid these issues, so you can focus on recovery.
Your Rightful Workers’ Benefits
Under New York Workers’ Compensation Law, you may be eligible for a range of benefits, depending on the severity of your injury:
- Comprehensive Medical Coverage: All necessary treatments, from surgeries to therapy, are covered under workers’ compensation. Your treating provider submits any medical treatment requests using the workers’ compensation portal. The insurance carrier hire medical professionals to review the medical requests made by your treating providers and either approve or deny the requests.
- Lost Wage Benefits: Receive up to two-thirds of your average weekly wage, easing financial strain during your recovery.
- Permanent Disability Compensation: Once you have reached Maximum Medical Improvement (MMI) for your injuries, the injured worker may be eligible to receive a settlement award. Our office ensures that you receive top value for your injuries – making sure that we maximize your settlement amount. Settlements are tax-free.
- Family and Funeral Benefits: In the unfortunate event of a workplace fatality, workers’ compensation may assist families with funeral expenses and financial support.
Common Workplace Injuries Covered by Workers’ Compensation
In New York, workplace accidents can happen in any environment. Some of the injuries we frequently handle include:
- Slip and Fall Injuries: Falls are common across many industries, leading to fractures, head injuries, and long-term mobility issues.
- Repetitive Strain Conditions: Continuous tasks, such as lifting or typing, can result in chronic conditions like tendinitis or carpal tunnel syndrome.
- Vehicle-Related Accidents: Delivery drivers and transportation workers are particularly vulnerable to on-the-job vehicle accidents. Aside from the workers’ compensation claim – If you sustained injuries while driving a motor vehicle, you may qualify for a Third-Party action against the insurance company of the negligent driver that caused the accident. Our firm is able to handle both portions of the injury claim – the workers’ compensation claim and the third-party action.
- Exposure to Hazardous Substances: Harmful chemicals and substances in industries like construction and manufacturing can lead to serious respiratory issues and long-term health complications.
If you’ve experienced any of these or similar injuries, Beck Law P.C. is ready to help you secure the benefits you need to move forward.

FAQ
Questions We Hear from Injured Workers
My boss is pressuring me not to file. What do I do?
File anyway. Retaliation against an employee who files a workers’ comp claim is illegal in New York. If your employer fires you, demotes you, cuts your hours, or makes your life miserable after you file, that’s a separate legal violation. Document everything and call us.
The insurance company denied my claim. Is that it?
Not even close. A denial is a starting point for an appeal, not the final word. We file Notices of Appeal and represent clients at hearings before Workers Compensation Law Judges. Plenty of denied claims get reversed with proper representation.
Can I choose my own doctor?
Yes — as long as the doctor is authorized by the NY Workers’ Compensation Board. You do not have to use whatever doctor your employer’s insurance company points you to. That doctor works for the insurer. Yours should work for you.
How long will my case take?
It depends on the injury, the insurer, and how contested things get. Simple cases with cooperative insurers can resolve in months. Disputed claims with permanency hearings can take a year or more. We keep you updated throughout the process.
I'm undocumented. Do I still have workers' comp rights?
Yes. New York doesn’t ask about immigration status when it comes to workers’ comp. You have the same rights as any other worker. We’ve represented undocumented clients throughout Queens and never once has their status been a barrier to recovery.
My injury happened slowly — repetitive use, not a single accident. Does that count?
Yes. Occupational diseases and repetitive stress conditions — carpal tunnel, hearing loss, back degeneration from years of heavy lifting — are covered. The rules for filing are slightly different, so call us to sort out the specifics for your situation.
